Bis zum Inkrafttreten des Vertrags von Lissabon lag die Durchführungsbefugnis beim Rat, der die Annahme der Durchführungsrechtsakte anschließend an die Kommission übertrug.
Nunmehr erkennt Artikel 291 des Vertrags über die Arbeitsweise der EU die grundsätzliche Befugnis der Kommission an.
